ABSTRACT
Due to the high demand for transplantation that is not followed by the availability le4514q56vel of the organ,at least 19 people per second around the world died because they not get the organs that they need. The organ is not only be taken from a man who is still alive, however it could also be taken from cadavers (donor dead brain stem). Therefore, in this journal the author will write about the transplant of the cadavers. The discussion of this journal will include for the rules of the law in Indonesia that control about transplant the organs of the body on the dead and legal sanctions that will be given to medical personnel if they made a mistake or violation at the time of before, during, and after the transplant. The type of research that the authors use is normative research. After the author learned the regulation of the law about organ transplants, the author conclude that in Indonesia there are no legal protection that may protect the donor,the recipients and the medical personnel who did the transplants. Even though, There are a few rules that may connecting into the UU RI No 36 Tahun 2009 Tentang Kesehatan and Peraturan Pemerintah Republik Indonesia No 18 Tahun 1981 Tentang Bedah Mayat Klinis dan Bedah Mayat Anatomis dan Transplantasi Alat atau Jaringan Tubuh Manusia.

ABSTRAK
Tingginya permintaan transplantasi yang tidak diikuti dengan tingkat persediaan organ, maka setidaknya ada 19 orang per detik di seluruh dunia yang meninggal karena tidak mendapatkan organ yang dibutuhkan. Tujuan penelitian ini yaitu untuk menganalisa ketentuan hukum yang mengatur dan yang berlaku terhadap tindakan transplantasi organ tubuh pada mayat. Selain itu juga agar mengetahui sanksi hukum yang diberikan pada tenaga medis bila melakukan pelanggaran maupun kesalahan transplantasi organ tubuh pada mayat. Penelitian ini menggunakan metode penelitian normatif Setelah diteliti, Regulasi mengenai Hukum yang mengatur tentang Transplantasi organ tubuh pada mayat jelas belum memberikan perlindungan hukum yang pasti kepada pendonor, penerima donor, dan tenaga medis yang terlibat dalam kegiatan transplantasi organ. Namun, masih ada payung hukum bagi pendonor yaitu apabila si tenaga medis melakukan kesalahan dalam menjalankan praktek yang berkaitan dengan kegiatan transplantasi dimana diatur dalam UU RI No 36 Tahun 2009 Tentang Kesehatan dan Peratiran Pemerintah Republik Indonesia No 18 Tahun 1981 Tentang Bedah Mayat Klinis dan Bedah Mayat Anatomis Serta Transplantasi Alat atau Jaringan Tubuh Manusia.
